Seminole Tribe v Florida

In Fitzpatrick 1976 court held Congress could abrogate state’s 11th am immunity and allow states to be sued directly for retrospective damages under its enforcement power in 14th amendment. In Union Gas 1989 a divided court held the same in respect of the commerce clause. Seminole Tribe v Florida 1996 overruled Union Gas rejecting claim that communist power could abrogate a state’s 11th am immunity (thus adding to the ant-federalist revival of the 1990s).
